Acting on the basis of the Law of Ukraine, the Foundation for Development of Ukraine (hereinafter referred to as “Customer”) announces an auction (tender) to purchase foods under implementation of the project “Social Support of TB-Infected People in Donetsk Region” on the terms specified by the present tender documents. The Foundation invites all individuals and businesses (residents and non-residents) intending to participate in food purchase project to submit their tender applications in compliance with the terms of the present tender documents.

6. Opening of tender applications:
6.1 Applications shall be reviewed at: 117, Postysheva Street, Donetsk 83000, Ukraine; Foundation for Development of Ukraine. Representatives of applicants can partake in the tender (at will).
6.2 Date and time: 09 April, 2008 at 11:00 (Kiev time)

7. Terms of supply (explanation):

7.1 According to the terms of the contract and with due regard to the list and specifications, the winner shall prepare food sets, pack, and deliver them once in three months according to the order-list provided by Regional Clinic TB Hospital to the network of anti-TB and general medical treatment facilities of the following towns and cities: Donetsk, Mariupol, Gorlovka, Yenakiyevo, Dzerzhinsk, Selidovo, Shakhtyorsk, Telmanovo, Maryinka, and Volnovakha. The delivery of food items shall be carried out exclusively in assortments and amounts specified in the customer’s order. The winner shall be accountable to the Foundation for Development of Ukraine.

7.2 Tender application of the Participant shall comprise the following documents:
- register of documents submitted as a part of tender application;
- application;
- participant profile;
- price profile;
- documents confirming compliance of the Participant with fixed qualifying requirements;
- copies of documents on state registration of the Participant (except for individuals that are not involved in business activity or are non-residents of Ukraine);
- copy of all passport pages (for individuals only);
- copy of taxpayer ID of the Participant (only for individuals that are residents of Ukraine);
- copy of VAT or unified tax payer certificate (except for individuals not involved in business activity or non-residents of Ukraine);
- copy of certificate on registration issued by Regional Statistics Department (except for individuals or non-residents of Ukraine);

7.3 Tender application price shall:

- be specified before the application submission;
- meet the current Ukrainian legislation;
- include expenses on:

• § all taxes and duties which are paid or must be paid according to the current legislation of Ukraine;
• § delivery of purchase object and its handling at the point of destination;
• The tender application price shall be determined clearly and ultimately without any references, restrictions or cautions.
• The tender application price shall remain permanent over the period of tender application validity.
• The participant shall undertake responsibility for obtaining all licenses, permissions, certificates on the purchase object, as well as other documents which are mandatory according to the current law of Ukraine. The participant shall cover all expenses required to receive these documents.
• The tender application price shall not include expenses incurred by the Participant to pay for information, consultation, consulting and other services, as well as expenses related to signing of the contract.
• Expenses of the Participant related to preparation and submission of the tender application shall not be refunded (even in case of cancellation or failure of the tender)

7.4 The Participant shall submit officially confirmed information on his/her compliance with the following qualifying requirements:

- availability of a permission or a license to implement activities required for the present purchase (in case such the license is demanded by the law of Ukraine);
- payment of taxes and duties (mandatory payments) stipulated by the current legislation (except for individuals not involved in business activity or non-residents of Ukraine);
- engagement in economic activity according to Participant’s charter (for businesses as economic entities);
- availability of equipment and employees with appropriate skills required to ensure the purchase including:

• § store premises suitable to store purchased goods with an area as large as specified by licensing requirements;
• § transport suitable for delivery of the purchased goods.

7.5 As a part of his/her tender application, the Participant shall submit the documents confirming his/her compliance with the established qualifying requirements.
7.6 The Customer and Participant whose application has been selected shall conclude a purchase agreement in compliance with the requirements of tender documentation after 5 working days from the date of written notification of all Participants on the bidding results, but not later than on 21th working day from the day of acceptance.
 
7.7 Any expenses incurred by the winner as part of tender participation and conclusion of the agreement shall not be regarded as detrimental and shall not be subjected to refunding.

7.8 To bid in the tender you should submit your price proposals concerning the total cost of food items in amounts and assortments mentioned in the specification.

7.9 The winner shall be the candidate, who offers the minimum price, provided that the price, quality, and terms of delivery meet Customer’s demands.
